ARTFITNESS – TERMS AND CONDITIONS

These Terms and Conditions govern the provision of fitness services by Arturas Bingelis trading as ArtFitness (“ArtFitness”, “we”, “us”, “our”) to clients (“you”, “your”).

By booking, attending, or participating in any session provided by ArtFitness, you agree to be bound by these Terms and Conditions.



1. About ArtFitness

ArtFitness is a sole trader business operated by:

ArtFitness provides outdoor fitness instruction services in public park environments.



2. Services Provided

ArtFitness provides:

1:1 outdoor fitness sessions

Small group outdoor sessions (maximum 16 participants)

Structured interval walking

Bodyweight exercises

Resistance band training

Light freeweight exercises conducted outdoors

Running may be incorporated as part of interval training where appropriate and suitable for the participant.

ArtFitness provides general fitness instruction only.

ArtFitness does not provide:

Medical exercise prescription

Rehabilitation services

Physiotherapy

Clinical treatment

Medical diagnosis

Personalised therapeutic or clinical nutrition advice

Any discussion of nutrition is general guidance only and not medical advice.



3. Eligibility & Health Requirements

3.1 Age Requirement

Services are for individuals aged 18 years and over.

Minors may attend designated family walking sessions only when accompanied by a parent or legal guardian. Full responsibility for minors remains entirely with the parent or guardian at all times.



3.2 Health Screening & PAR-Q

All clients must complete a health screening questionnaire (PAR-Q or equivalent) prior to participation.

Clients must be:

Apparently healthy and capable of participating in moderate physical activity without medical supervision.

If you answer “YES” to any PAR-Q question:

You must obtain written medical clearance from your GP prior to participation.

ArtFitness reserves the right to decline training even where GP clearance is provided if the condition falls outside the instructor’s qualification, professional competence, or scope of practice.

GP clearance does not guarantee acceptance as a client.

You confirm that all health information provided is accurate, complete, and truthful.



4. Voluntary Participation & Assumption of Risk

Participation in any ArtFitness session is entirely voluntary.

By attending a session, you confirm that you:

Choose to participate of your own free will

Understand that physical exercise involves inherent risks

Accept responsibility for your decision to participate

You acknowledge that participation in physical activity may involve risks including, but not limited to:

Muscle soreness

Strains or sprains

Falls

Injury

Outdoor sessions take place in public park environments where additional risks may include, but are not limited to:

Uneven ground

Wet or slippery surfaces

Mud, gravel, or loose terrain

Traffic near park perimeters

Cyclists and other park users

Dogs or animals

Children and toys left in public areas

Debris or objects on the ground

Falling objects such as tree branches

Changing weather conditions

Public environment hazards

Any other unforeseen environmental risks

You understand that exercise intensity is self-managed.

You confirm that:

You may stop exercising at any time

You should immediately stop if you feel pain, dizziness, discomfort, shortness of breath beyond normal exertion, or any unusual symptoms

You will inform the instructor immediately if you feel unwell or uncomfortable

ArtFitness will provide instruction and guidance, but you remain responsible for listening to your body and acting within your limits.





5. Clothing & Personal Responsibility

Clients are responsible for:

Wearing appropriate clothing and footwear suitable for outdoor exercise

Dressing appropriately for weather conditions

Bringing adequate hydration where necessary



6. Booking & Payment

6.1 Payment Methods

Payments may be made via:

Online booking systems (third-party providers)

Bank transfer

Cash

Card reader or mobile payment processor

All payments are processed through third-party providers. ArtFitness does not store or control payment card data.



6.2 Session Options

ArtFitness offers:

Pay-per-session bookings

Block of 10 sessions (valid for 10 weeks)

Block of 20 sessions (valid for 20 weeks)

Sessions expire after their stated validity period unless otherwise agreed in writing.

Sessions are strictly non-transferable.



7. Refund Policy

Refunds may be considered in limited circumstances, including:

Worsening medical condition preventing participation (written GP confirmation required)

Permanent relocation or temporary relocation preventing use within expiry period

Refunds for unused block sessions are calculated as follows:

Used sessions are charged at the full single-session rate (without block discount), and the remaining balance is refunded.

Example:

If:

Single session price = £100

10-session block price = £900

4 sessions used

Refund = £900 – (4 × £100) = £500

Expiry extensions due to temporary relocation may be considered at ArtFitness’s discretion.



8. Cancellation Policy

8.1 Client Cancellation

A minimum of 12 hours’ notice is required to cancel or reschedule a session.

Cancellations made with less than 12 hours’ notice are considered used sessions.

Failure to attend (no-show) is considered a used session.

8.2 Lateness

Sessions will begin and end at the scheduled time. In the event of client lateness, the session will conclude at the originally scheduled end time to avoid disruption to subsequent bookings. Time lost due to lateness will not be extended or refunded.

Being 20 minutes or more late after the scheduled start time is considered a no-show. This is due to safety requirements, including appropriate warm-up and mobility preparation before exercise.

8.3 Discretionary Rescheduling

ArtFitness reserves the right to offer a discretionary reschedule in exceptional circumstances. This is not guaranteed and is assessed on a case-by-case basis.



9. Weather Policy

Sessions proceed in light rain.

Sessions may be rescheduled in cases of heavy rain, storms, extreme weather, high winds, icy conditions, or any environmental circumstance that may pose a safety risk.

The final decision regarding whether a session proceeds or is rescheduled rests solely with ArtFitness.



10. Personal Belongings

ArtFitness accepts no responsibility for loss, theft, or damage to personal belongings brought to sessions.

All personal items are brought at your own risk.



11. Client Conduct & Behaviour

ArtFitness operates a respectful, professional, non-smoking, non-drinking training environment.

Clients must:

Behave respectfully

Follow instructor guidance

The following are strictly prohibited:

Aggressive, abusive or threatening language

Harassment

Discriminatory behaviour

Client must not be intoxicated

Smoking or vaping during sessions

ArtFitness reserves the right to:

Refuse service

Remove a participant from a session

Terminate an agreement immediately

Decline future bookings

In cases of serious misconduct, termination may occur without refund.



12. Insurance

ArtFitness maintains appropriate public liability insurance in accordance with UK industry standards.

Proof of insurance may be provided upon reasonable request.



13. Limitation of Liability

Nothing in these Terms limits or excludes liability for:

Death or personal injury caused by negligence

Fraud

Any liability that cannot legally be excluded under UK law

ArtFitness is not responsible for:

Injury resulting from failure to follow instruction

Injury resulting from undisclosed medical conditions

Injury resulting from failure to exercise within personal limits

Loss or theft of personal belongings

Indirect or consequential loss



14. Website Use & Third-Party Platforms

ArtFitness may use third-party platforms for:

Booking

Form completion

Calendar scheduling

Payment processing

ArtFitness is not responsible for the availability, functionality, or policies of third-party services.

Users are responsible for reviewing the terms of those third-party providers.



15. Intellectual Property

All content associated with ArtFitness, including but not limited to:

Logos

Branding

Graphics

Text

Session structures

Marketing materials

Website content

remains the intellectual property of ArtFitness.

No material may be reproduced, copied, distributed, or used without prior written permission.

The name “ArtFitness” is used as a trading name and may be subject to trademark registration.



16. Data Protection

Personal data is handled in accordance with UK GDPR and applicable data protection legislation.

17. Changes to Terms

ArtFitness reserves the right to update these Terms and Conditions at any time.

Continued participation in sessions constitutes acceptance of the most current version.



18. Governing Law

These Terms and Conditions are governed by the laws of England and Wales.

Any disputes shall be subject to the jurisdiction of the courts of England and Wales.
